Corner crossing SCOTUS appeal

Good bit of trail cameras in the area.

Daughters think we should live stream it and invite the Governor, AG, FWP director, County sheriff, county DA, Elon Musk (for star link), and the landowner.

Could see the headline now. Father and 5 daughters arrested live in Madison county for trying to access state land for elk hunting. Should go over well.
Ah, it is State land. Might not be able to sue under federal statute then. However, it is a false sign. It misstates the law and might constitute hunter harassment, however, because it is incorrect and meant to intimidate people exercising their right.

BLM to state, blm touches the highway state is landlocked. I’ve been wondering how that would affect it?

if a landowner puts up a sign, wire mesh and a trail camera at a corner and one is state and one is blm and I believe I have the right to access across the corner, now I’m on state land, now I want to step back on that BLM and those things are still intimidating or attempting to stop me from doing that. How would that not apply under unlawful enclosure?

Just based on the sign I figured it was that particular state/BLM corner in Madison County. Haven’t been there in a bit, but the sign doesn’t surprise me at all.

I believe the UIA only applies to federal lands, not state.

No, it applies to both state and blm. Judge Skavdahl clarified that in the Iron Bars case but he did limit it to the railroad swath ie + or - 40 miles along the railroad grants. Remember in 1885 state lands didn’t exist yet as the 1885 (UIA) Act preceded Wyoming statehood of 1890.

So what is the answer for Montana and other states in our district? Do hunters and other public land use groups sue, or do we wait for someone to get a ticket and fight it that way?

I'm sure a lot of you also got this email.

It pisses me off that FWP gets involved with issues that are not there's. Trespassing is not a game violation. Stay in your lane. A Sheriff isn't going to write you a ticket for not wearing orange. I'm fine with a game warden writing a trespass because you broke the law, but not them spouting what is now becoming their opinion.

Even when they lose, they still think they have leverage...I tend to disagree.

“I foresee that this will lead, in some instances, to corner crossing that will result in some abuses,” he said. “It’s one thing if a few hunters go across the corner. It’s another thing if all of a sudden 100 people want to have an event."

Sounds like he'd like you wyoming guys to have a 101 person bbq on some land locked public 🤷‍♂️

"But while corner crossing might be a tresspass, it was not a hunting violation that Game and Fish could prosecute, the opinion stated."

A quote from Wyoming's G&F previous of this case, from the article Buzz posted. Seems Montana FWP could learn a few things when it comes to this.
