Point to be made if it was illegal to gather evidence via drones. I'd be almost certain that law was written to fight animal rights activisits taking video of abuses in large feedlots/hog lots etc.

But if I were the warden in this case my goal would not have necessarily been to win a case, but to expose the guy. Sounds like a real scumbag who flaunted multiple laws and might well have contributed to CWD concerns while ignoring those laws...

We have a guy in MN like this and he is a major piece of work.

As a person not in law enforcement or the legal system, why did the DNR cover the suspects game cameras?

Just my uneducated thought would be that his cameras recording the evidence gathering would support the DNR if what they were saying were true.

Hot take given without knowledge of Iowa state law regarding drone usage. So for whatever it’s worth given that caveat.

The article states that the tip was given by an unidentified informant who had flown a drone over the property. There’s a lot of potential scenarios where a citizen could be legally, (or illegally) flying a drone over an area and see what they interpret as illegal activity and then turn over that evidence or make a complaint to law enforcement.

That doesn’t mean that law enforcement violated his 4th amendment rights if they’re given probable cause to get a search warrant from a confidential tip.


I was involved in witnessing a poaching incident that happened in a public setting where I was fishing with my kids. As I recognized that a violation was occurring I videoed the incident and turned it over to law enforcement. The poachers tried to claim their right to privacy was violated because they didn’t know I was filming and they hadn’t been informed or given consent. That “defense” didn’t get them very far.

Generally, a 4th amendment violation by a third party is not a prohibition from law enforcements use. The exclusionary rule doesn’t apply unless the law enforcement directed the third party to commit the violation.

It is not used in row crop ag spray that i know of. Its used on directly on dogs and humans as a repellant. Very infrequently used around corrals and barns.

It doesn’t take cool camo, major sponsors, food plots, or even trail cameras to kill big deer here. What it takes is access to un pressured land and the flexibility to spend some time in the stand…..and you can’t have EHD. That’s it. They arent secret nocturnal monsters….theyre deer driving by their urge to eat and screw; preferably done without pro Hunter Joe walking in daily to check his trail cams. Anyone who follows these dorks or thinks they even have an ounce of credibility is doing so through a jaded pair of rose colored glasses. Rant complete

That answer may be Iowa law specific but most of the time it would be required to be disclosed unless the state argued that the disclosure would present a danger to the informant.

But it says the charges were dismissed it may or may not be disclosed in the civil case.
