Does someone think the behavior of companies will change based on this? It seems like the difference is whether people are illegal or not.

The way federal regulators allow companies to behave would absolutely change. If you remove guardrail on a cliff, it doesn’t change the speed of drivers going around the curve but it sure as hell changes the outcome.

Yes.

As long as the purpose of killing them isn’t the intent, you can kill as many as you want, basically. I know and work with myriad companies that will remain nameless that will absolutely put the pedal to the metal on this, because they have a track record of doing so previously until stopped by legal actions based on these (now former) protections. The energy and data sectors specifically are licking their chops.

The thing people continue to ignore is that most regulations stem from an actual problem that was happening in history. Whether they work as intended may be open to debate, but I wish instead of throwing the whole works in the trash, we were smart enough to critically review the issue and make reasonable adaptations to the law. It seems like there is an incredible naïveté in thinking we aren’t going right back to those historic issues when we gut the regulations.

This will result in no change in behavior for my business. We have no desire, need or want to harm any endangered species. The legality of killing an ES never entered into the equation. We have an awesome track record of not only no harm but providing beneficial habitat for them post, and to a lesser degree during, mining. (Raptors love a good highwall). We will continue to do the same going forward.
