FWP lies about Corner Crossing

What’s a good corner crossing defense number to budget for? That article kind of makes me want to call that obvious bluff. Guess it’s the poker player in me coming out.
If you do it right - im willing to bet youd also get an outpouring of financial support. Ive got 100 planned for it.

More likely - as the director eluded to - no prosecutor will take it:

“What we’ve said is, if you have a situation and it is truly an unlawful corner crossing, then write the ticket,” Clark said. “Whether or not the county attorney prosecutes, it doesn’t have any bearing on what we do.”

Even more compelling to that point :

"Clark said she had fielded calls from landowners during the last hunting season about hunters confused about whether the court ruling applied here."

“They think they can corner cross now, but they’re not going from corner to corner,” she said, adding that landowners had reported hunters crossing swaths of private land to bridge between public parcels — clearly unlawful."

Yet we havent seen a case where charges like that have been taken to trial.
 
I think they would rather try and convince people that it is illegal so they don't do it. But I think they don't actually want to prosecute anyone and lose. This article doesn't say it, but we (MWF, BHA) met with their attorneys and law enforcement a few months back and learned that they didn't file a single case last year.
Thank you for sharing. Did they further try and gaslight you guys by saying the reason they didn’t file any cases was because there were no conflicts (I.e. no one crossed a corner and upset a landowner) because everyone knows it’s illegal and isn’t crossing corners?

Every year that goes by without them filing a case continues to set expectations/precedent against them. The question is begging to be answered and the fact we have decade(s?) worth of this occurring and not a single case is pretty telling to me.
 
I know a couple of attorneys that might take it for free. It's a misdemeanor charge, so a criminal defense attorney would probably only charge a few grand to defend it. A favorable jury verdict wouldn't change the law on it though.

I will say I think Dir. Clark is in over her head on this one. Calling it "corner crossings" and not corner crossing shows that she isn't really educated on the issue, and from those I know that were at the EQC meeting, she seemed to be conflating CC with trespass that isn't at perfect corners. I think she is simply taking her talking points from those above her who have worse intentions.
