You left out the knowing and purposely. If the road in question has been removed from gas tax inventories and it is even remotely questionable an easement exists, you’ll be hard pressed to ever get a conviction for criminal mischief. You may think that’s a good hill to plant your flag on, but I don’t.

I’d the easement issue is black and white, then this should be an easy matter to resolve.

So - they didnt know people used the road previously?

Knowing and purposely seems implicit to this - if people from the public werent accessing previously - who was getting stuck?

I said easy, in a legal sense. Not cheap or quick.

And yes, PLWA is a very good use of money.
 
This is something that concerns me. I am in the process of selling my house and separating with my wife, and we got an offer on our house the first day we put it on the market. Only problem is CA has all types of taxes. I have narrowed down to 2 states I would like to buy land in, as an insurance policy, and to possibly mill timber from the property and hunt. North Idaho and Montana are the 2 states. I have 2 friends in the Bozeman area. One just told me that yesterday they submitted legislation in MT to charge 2%~ tax on property not used as a perm residence.

Me and my wife are going to get hit hard on taxes on CA, and I have a piece of property in Lake County, CA I will move all of our belongings to. But I will want to find 10-50 acres that I can hunt and build on...a 500 sq.ft. timber home and a 5000 sq.ft. shop would be just dandy for my needs. Ideally, a shop with a bathroom (same as I have in Lake County, CA).

This public land dilemma is horrifying...not that it would pass congress, we don't know that yet, but CA also has a lot of BLM land with their crosshairs on selling...maybe Trump will sign an EO that prevents that states from selling off public land, which is owned by the Feds, AFAIK.🤷‍♂️
 
Some Qs I have for you Montana folk, is, in regard to taxes. My understanding is that MT is .79 % of purchase price, and does that hold true for additional living space? Also, MT doesn't have sales tax. Starts to get complicated. What about your fish and game? ID Fish and Game are bad people, AFAICT.

ID is only .4 %. So, as long as I can claim residency in another state, I only need to stay out of CA for less than 6mo/year, or am I missing something? As long as I reside in ID or MT, I think I can claim residency there. CA tries to make it as difficult as they can, tax wise, for people that want to leave. But my CPA said more and more people are thinking like me...take your losses and pay the horrendous tax to get out, it will only save on taxes in the future. As it is, gas will be over $8/gal soon in CA, and I estimate it will be $10/gal before long. People like me are fed up with this BS that Newsom spews, we the residents know better than anyone else.

Yes, just that I don't want to be there when it's 35. I would for hunting, and without my wife I could probably rough it with enough firewood, but plan to stay in CA during the winter, the 50s is cold, but it does get in the 40s occasionally (NorCal). What about humidity during the summer, is it bad in MT/ID?

One good thing about ID is that Spokane is close and has Kaiser. Even with Medicare, I pay $2k/year to Medicare, and $2k to Kaiser for the SS supplement. Spokane is only 30 miles from Coer D'Alene.

The other thing is, I like to swim, and Bonners Ferry has a Municipal pool which is open after June 1st. This summer, the pool is free to the public. If I find land in Bonners Ferry, I'll drive up, camp on the property and swim/shower at the Municipal pool.

I realize I would need to be near a big city. Not sure if Bozeman is that area or not. Are there pools in Bozeman area? So much to research in picking a state to live...

Are you referring to Coer D'Alene? My good friend I went to middle school with lives in Coer D'Alene, he's a real estate agent...but it seems to me that Coer D'Alene is filled with a lot of the type of folks I'm trying to get away from in CA. Sandpoint also...but by the time you get up to Bonners Ferry, nobody wants to be up there...but that is where a LOT of public land is located. I want to watch how the public land sell plays out...

Not quite tracking. Unless your saying to many conservatives moved to MT and ID post Covid and that’s not the crowd that you want to be around.

Conservative Right Wing Real Estate businesses popped up in these areas, especially North ID during Covid.

So if that’s your crowd that’s your place.

That's why I said we're not even on the same page. I was saying exactly the opposite.

Or, at least how I see it. Many liberals from CA moved to CDA area, and also Sandpoint to some extent. Same problem for me in Lake County, CA. It is plagued with liberal CA folks owning second homes there. I am kind of person the liberals like to blame.

I was kind of saying that CDA seems the most liberal to me, Sandpoint less so, and Bonners Ferry the least. Bonners Ferry has the most boxes checked for me, if I can claim residence there.

Aside from Bonners Ferry being more of what I like, there's a lot of public land that could be under attack with the recent bill by the Utah Senator. Utah is too liberal for me, and I will not consider UT as a possible state. CA is also under attack, and if I stay in CA, Northern California BLM land stands the most to lose. Anything that could be turned into a local fraud will go through.

My concerns with ID are:
1) amount of snow and duration
2) Selling of public land and IFG, they oddly don't seem very good for hunting.
3) What type of purchase is required for residency?

My concerns for MT are:
1) Higher property tax, but no sales tax.
2) Same selling of public land issue, see 2) above for ID
3) Building permits

I have 30 days for escrow to close, and until then I am without cash to make any offers. My plan has been to wait until after Labor Day, where I think the buyer has a huge advantage with winter approaching for both ID and MT. Both suffer from the liberal movement I'm intertwined with. Those people don't like me hunting in CA, or any state for that matter. Please don't lump me in with them.

This is an example of what I was looking at, buyer couldn't wait, but it has all utilities in for home and shop, no permits are needed. I don't see any way around the purchase price, so in this case you could in theory create living space in the shop, or at least park an RV in there. ID would probably welcome residency. But what if the selling of public land f#@$s up the migration path of the very animals I want to hunt on my property. That's all from the Kootenai River, down into the Preist Lake, Sandpoint, and even Coer D'Alene...they can't get rid of the game, even if they did, but I don't want to be surrounded by residential in 20 years, either.
