I didn't see CBD or Western Watersheds on that one, so I'd say it's desperation. The precedent from the 9th is binding according to Molloy, and for the 9th to reverse that precedent, especially after more conservative judges have been appointed by President Bush. I think we're looking at the last gasps of a desperate few.
