Archery in Montana is about one thing IMO, being able to elk hunt during the elk rut. If you separated the two nobody would care about even using rifles during the archery season. So if someone was disabled and wanted to experience what elk hunting the rut was like a crossbow seems like a fair... -

Show me one time this has gone to a judge. Even the LEOs questioned admit this is a grey area. Any lawyer worth $100 would destroy a grey area charge like this, then there would be a bunch of pro-bono access right lawyers who would love to appeal a charge higher and take away the greyness all...- Hersbird

I guess I have to post here as the corner crossing topic although the same in nature is different in application. I don't see how this is settled. Why can't you fish back down the stream again exactly? Ps worring about weaking the stream access is a straw dog. They already fought that fight and... -

So don't "hike" the streambed, bird watch the stream bed. Wildlife photograph the stream bed. Heck, FISH the stream. Certainly that is a water based recreation. Many days hunting I hunt, then switch to fishing, then back to hunting.- Hersbird

If I am hunting forest service land south of highway 2 and I'm walking along and cross highway 2 to hunt the forest service land north of the highway I illegally just by default was "hunting" on highway 2? A note on trespassing "while hunting", would that even apply in corner crossing unless you actually stood on the corner and took a shot? You aren't "hunting" while crossing the corner, you are hiking. Same as if you are walking down main street and lose your balance and step off the sidewalk...- Hersbird

I say if anything pass the law deeming corner crossing legal and then if it us a civil matter let the burden of proving damage caused fall on the landowners who want to pursue individual cases against individual people in court. No law enforcement resources to be used in said pursuit.- Hersbird

Ironically the checkerboard was set up initially to encourage access. Nobody could build a cross country railroad using only the checkerboard peices they were given (not even purchased) without crossing corners. Now the checkerboard is used as a tool to deny access. I look forward to the podcast. But sorry I can't get this out of my head today. So say the eminent domain is tired on the 18 inch radius of the section corners, then pay the landowners $1000 for each corner in question so just compensation is made. Surely $1000 for a single square foot of land...- Hersbird

Thanks for the reply Randy. I do see that but then how does a voter initiative legalize the use, sale, and production of a federally outlawed drug like marijuana? I guess my main point is it's time to move this out of the legislature's hands and put it right into the voter's hands.- Hersbird
