Bill allowing crossbows during MT archery

And this applies to all the improvements made in all bows and gear throughout the years. People always want to freeze time right where they are at. I say we really juice it up and have a spear only season. If you and 3 buddies can't take a bull with pointy sticks you have no business crossing...

Bill allowing crossbows during MT archery

Archery in Montana is about one thing IMO, being able to elk hunt during the elk rut. If you separated the two nobody would care about even using rifles during the archery season. So if someone was disabled and wanted to experience what elk hunting the rut was like a crossbow seems like a fair...

    Access State Land via River

The language applies only to what you are doing between the high water marks, not what you do before or after.

    Access State Land via River

Let's talk about the spirt of the law and where the rights have come from. First it's the stream access law not the limits of stream access law. Second the rights come from the traditions in place before we were even a country. The rivers and streams are the highways, the access to the land...

Montana voter initiative for corner crossing.

Show me one time this has gone to a judge. Even the LEOs questioned admit this is a grey area. Any lawyer worth $100 would destroy a grey area charge like this, then there would be a bunch of pro-bono access right lawyers who would love to appeal a charge higher and take away the greyness all...

    Access State Land via River

I guess I have to post here as the corner crossing topic although the same in nature is different in application. I don't see how this is settled. Why can't you fish back down the stream again exactly? Ps worring about weaking the stream access is a straw dog. They already fought that fight and...

You get tired and hot hauling out that game. If only there was a spot to take off your boots and cool your feet in some fresh water. Would make the job almost recreation.

So don't "hike" the streambed, bird watch the stream bed. Wildlife photograph the stream bed. Heck, FISH the stream. Certainly that is a water based recreation. Many days hunting I hunt, then switch to fishing, then back to hunting.

Montana voter initiative for corner crossing.

So let me put it more simply. If I am hunting forest service land south of highway 2 and I'm walking along and cross highway 2 to hunt the forest service land north of the highway I illegally just by default was "hunting" on highway 2? It's the same with a river or stream. Rivers and streams are...

A note on trespassing "while hunting", would that even apply in corner crossing unless you actually stood on the corner and took a shot? You aren't "hunting" while crossing the corner, you are hiking. Same as if you are walking down main street and lose your balance and step off the sidewalk...

Montana voter initiative for corner crossing.

That thread is what prompted me to start a new one, I had a slightly different take mainly using citizen's initiative vs legislative initiative and figured the other was a bit old.

I say if anything pass the law deeming corner crossing legal and then if it us a civil matter let the burden of proving damage caused fall on the landowners who want to pursue individual cases against individual people in court. No law enforcement resources to be used in said pursuit.

Ironically the checkerboard was set up initially to encourage access. Nobody could build a cross country railroad using only the checkerboard peices they were given (not even purchased) without crossing corners. Now the checkerboard is used as a tool to deny access. I love the Constitution to...

I look forward to the podcast. But sorry I can't get this out of my head today. So say the eminent domain is tired on the 18 inch radius of the section corners, then pay the landowners $1000 for each corner in question so just compensation is made. Surely $1000 for a single square foot of land...

Thanks for the reply Randy. I do see that but then how does a voter initiative legalize the use, sale, and production of a federally outlawed drug like marijuana? I guess my main point is it's time to move this out of the legislature's hands and put it right into the voter's hands.
